Our Donor Commitment

We will not sell, share, or trade our donors’ names or personal information with any third party (other than local Youth United for Prosperity organizations and our service providers), nor will we send mailings to our donors on behalf of other organizations.

This Privacy Policy applies to all personal information received by Youth United for Prosperity Foundation (“YUP,” “us,” or “we”), both online and offline, on any platform (“Platform” includes the Youth United for Prosperity website), as well as any electronic, written, or oral communications.

1. Introduction

Your privacy is a priority for Youth United for Prosperity Foundation (https://www.youthunitedforprosperity.org). We want you to be familiar with how we collect, use, and disclose information relating to you, your computer, or your device—and any data that enables your identification (“Personal Information”). This Privacy Policy describes our practices with information that we (or our service providers) collect through our websites, applications, and other network-connected products and services that link to this Privacy Policy (collectively, the “Site”).

This Privacy Policy only addresses information collected directly through or from our Site; it does not address or govern any information-gathering, use, or dissemination practices related to information collected through other means, such as telephone, postal mail, or other offline methods.

Our Site is not intended for persons under the age of 16, and we do not knowingly collect Personal Information online from individuals in this age group. If we become aware that such information has been collected, we may delete it at our discretion.

Our Site currently does not respond to “Do Not Track” (DNT) signals. There is no industry consensus on how DNT signals should be interpreted, so we adhere to this Privacy Policy regardless of any DNT signal.

We do not sell your Personal Information. We only share it as described here or at the point of collection:

  1. Affiliates: Local Youth United for Prosperity organizations, for the purposes described in this Privacy Policy.
  2. Service Providers: Companies or individuals providing services for us, such as payment processing or website hosting.
  3. Organizational Changes: Third parties in the event of a merger, reorganization, sale, joint venture, assignment, transfer, or other disposition of all or part of our organization (including in bankruptcy or similar proceedings).

We are not responsible for these websites’ practices, and we encourage you to review their privacy policies before sharing any information.

We are based in the United States. Regardless of where you are located, your Personal Information will be collected and processed in the United States. The data protection laws of the U.S. may not be as comprehensive as those in your country of residence.

8. Security

We take reasonable steps to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. These measures include physical, electronic, and procedural safeguards:

  • We follow industry-standard security controls (firewalls, SSL/TLS encryption).
  • Credit Card Transactions: Processed only through PCI-compliant third-party processors.
  • Although we strive to protect your data, no online platform is entirely secure. Consequently, we cannot guarantee absolute security.
  • You agree that YUP shall not be liable to you for any modification, suspension, or discontinuance of the Site.

  • Automated Processing: You can request that your Personal Information not be subject to automated processing.
  • Deletion & Restriction: You can request erasure or restriction of processing in certain circumstances (unless required by law or necessary for legal claims).

12(c) California Residents and Other U.S. State Privacy Laws

  • California: The California Privacy Rights Act (CPRA) took effect on January 1, 2023, expanding consumer rights and imposing additional obligations on organizations collecting Personal Information of California residents. If you are a California resident, you may have the right to request information about our data collection practices, request deletion of certain data, opt out of “sale” or “sharing” of your data (as defined by California law), and exercise other rights under the CPRA.
  • Other U.S. States: Virginia, Colorado, Connecticut, and Utah have enacted state privacy laws that may grant similar rights to residents of those states.

YUP reserves the right to modify, alter, or update this Privacy Policy at any time. If we make changes, we will post the updated policy on our Site. The following terms and conditions (“Terms”) govern your use of this Site. By accessing, viewing, or using the content, materials, or services on or through this Site, you indicate that you have read, understand, and agree to these Terms, and intend to be legally bound by them. 9. Limitation of Liability

To the fullest extent permitted by law, YUP and its licensors are not liable for any indirect, special, incidental, consequential, or punitive damages arising from your use of or inability to use the Site or Site Materials, even if they have been advised of the possibility of such damages. In no event shall YUP’s total liability to you for all damages exceed the amount you paid (if any) in the preceding 12 months for using the Site. If you are dissatisfied with the Site or these Terms, your sole remedy is to discontinue using the Site.

YUP reserves the right to modify these Terms at any time. Use of the Site after changes are posted indicates acceptance of those changes. It is your responsibility to check for updates. YUP may suspend or terminate your account for any violation of these Terms or for any other reason at its sole discretion.

14. Governing Law and Jurisdiction

These Terms represent the entire agreement between you and YUP and are governed by the laws of the State of Georgia. You consent to the exclusive jurisdiction of the federal and state courts located in Atlanta, Georgia, and waive any jurisdictional or venue defenses otherwise available. You also waive any right to a trial by jury.

15. Miscellaneous

  • The Site is controlled and operated from within the United States. If you access the Site from outside the U.S., you are responsible for compliance with local laws.
  • The failure of YUP to exercise or enforce any right shall not constitute a waiver of such right.
  • Section headings are for reference only.
